I am one of the July 2 filer and calling the level 2 does not help should I check the TSC than NSC with them for my 485 app or it does not matter, my 140 was approved from NSC with April 2005 priority ....

EB3-India with PD 2003 and before - Most will be out by December 2008 -
Perhaps 10% may still rot in NC further.
EB3-India with PD JAN 2004 - DEC 2004 - Most will be out by August 2009
Perhaps 20% may still rot in NC
further.

I didn't say GC holder can get security clearance. I was listing one scenario where employer is exempt from the requirement as per law.

Practically there are many ways a company can avoid hiring an H1B or GC if they want to. But the point is, as per law that is illegal.

You should see the paper copy of receipts in your mail box today as I already got mine monday.Still waiting on my wifes. Was your at NSC too.. I wrote my name on the checks to differentiate. So I knew they were mine.
My attorney is not organized man. he is #$$%%%^. so worried whether he sent it or not. Is your wife working too by any chance.
I wrote the amount in words wrong, the numerics were right. so they returned my wifes application. I will resend it tomorrow.

And who is hurting because of this? Is it not you? And me? and our families? Whose fault is it that we refuse to actively participated in the effort that wants us to lead a stable life.
You see, most people here work in IT. So we have binary logic. 0 & 1. There is no in between. So most people in this community of educated illiterates wants the world to be perfectly aligned before we lift a finger. Lets wait for few more years for GC before we contribute my hard earned $20 after bickering for 10 years, way to go.

You have predicted that EB3-India cut of date would become June 2003. But your PD is July 2003. Usually people do not predict that way. They predict their own PD would become current pretty soon.:D

IV is not biased against any EB category. Their goal is to have process so that everyone gets GC in one year from date of application. These categories are set by USCIS. IV is currently in process of detailing solutions to end this misery of all EB category. More details can only be find in your respective state chapters. We cannot disclose details on the public forum. I will urge you to join your state chapter so that you are aware of what all IV is trying to do. IV is not trying to make system work for EB2 or EB1 but for everyone. There are lot of solutions, but we need to lobby and for that we need volunteer. Remember IV is not a corporate who has people working on its payroll and getting revenue. All of us need to contribute and volunteer. Trust me the day all of us (at least number of people blogging currently) join their state chapter and volunteer couple of hours in a month, you will not need lobby. The public voice be enough to convince Hill and House to pass a legislation.

Section 202 of the Immigration and Nationality Act (INA) states that the per-country limit for preference immigrants is set at 7% of the total annual employment-based preference limits. This means a country with large population like India and a tiny country like Lichtenstein get same number of visa numbers. This system is designed to systematically discriminate people from India and China by preventing them from attaining employment visas. More research needs to be done whether this constitutes a violation of US Equal Employment Opportunity Law. We need to find out whether this constitutes discrimination by national origin.
