    Ha ha Congrats....

    Story of my life. I complain about delay with my application. Someone joins me and tells me they are in the same boat and the very next day that someone leaves the boat and jumps into "greener" pastures. Everyone is leaving the boat and I seem to be left out :(

    Who else are in my boat? (Application with an officer for over 2 weeks and still status = "Initial Review")

    My wife and I just received the email about card production order. And, ou4 case status has changed on the website to CPO. I wish good luck to all of you. In case it helps, anyone, our details:

    Priority date: Feb 26, 2006
    I-485 Receipt date: Jul 27, 2007

    Steps taken:
    SR opened for my petition around July 17th: Response stated that my petition was in the adjudications department, and was for an officer to be assigned.
    Status enquiry through the local congresswoman Aug 12th: Same result as my SR.
    SR opened for my wife Aug., 10th: No response yet
    Infopass appointment on Aug. 16th: Both petitions with an officer since Aug. 12th.

    I appreciate the forum and all the support it offers. Donated last month.

    EB3-India with PD 2003 and before - Most will be out by December 2008 -
    Perhaps 10% may still rot in NC further.
    EB3-India with PD JAN 2004 - DEC 2004 - Most will be out by August 2009
    Perhaps 20% may still rot in NC
    further.
    EB3-India with PD JAN 2005 - April 2005 - Most will be out by April 2010
    Perhaps 5% may still rot in NC
    further.
    EB3-India May 2005 Onwards - Can not predict - It is good to look for other
    options and that option certainly MUST not
    be switching to EB2

    My labour and I-140 is approved last year and I am working with current employer from last 1 and half years. Employer is making good money trough me.

    As now the dates are current, my employer is trying to exploit me.
    He is not responding to my mails, and not picking my phone.

    Last modified message which I got from him is that:

    The whole financials for the company changes with filing 485 for you immediately. So, it is definitely a loss for company to process your 485 immediately.

    you need to come with items that you are ready to compromise in return; so that the company also benefits by helping you."

    I am very much in tension and he is talking to me.

    Can someone suggest what may be the option for me?

    If this is the exact verbiage from his email, You can sue him for lying that filing for your 485 is a loss to company. Talk to a lawyer like Rajiv Khanna or Shusterman if he doesn't hep you file 485 before PD retrogresses. Get as much evidence as possible in email mean while, to set the record straight with a good law suit. If I were you, I would naively try to send an email explaining him that you have no intentions to abandon, company's financials are not affected because of your 485 (its totally personal) and get more crooked responses. Disgusting mo fo's. The most f#$%^ing irony is these AH's have gone through this and know the pain.

    On Aug 19th we got our CPO emails. I was on vacation so couldn't post the message to the site. After that no updates from USCIS. Still waiting on the Notice mails.

    you got to make your decision dude, however, in my case, i would opt for W2. 1099 is a temporary thing... thats my opinion... you did not ask me specifically to share this, but hey, this is a public forum... :-)

    I am not planning to open a company for this. If possible, I would rather work as an independent contractor on 1099. Now, after reading the last few posts, it looks like there are three things I need to worry about in case of a RFE -

    1. Job should be bona fide (without going into the definition of the word).
    My project is going to be with a large Bank through a big, wellknown consulting/outsourcing company. That should take care of the 'bonafide' part.

    2. Should have similar/same job duties/responsibilities.
    I am still waiting for the contract, however I can have my job duties/responsibilities listed out in my contract with the company. I am sure I can get a letter from the client too if it comes to that.

    3. Job should be permanent - This is something I may not be able to prove. Since the project is short term, I am sure my contract will mention that. I am trying to convince the company to at least include "contract-to-hire" in the language of the contract. Since this project has potential of becoming long term, company is not averse to this idea.
    Will having 'contract-to-hire' in the contract take care of this question (if a RFE comes).

    This is really a sorry situation. On one side your employer is saying wholy company's fiancial is dependent on you and on other side he is asking how can you benefit company. There is not much you can do other than doing a sweet talk him and see if you can come up with some compromise.
    He might ask you to sign some bond to stay in the company for next few years. See if you can reduce that duration as well as get the surety that will not impact your increment.

    Although several people will advise you for the aggresive stance but I don't think you would like to move in that direction.

    Other option is to file your I-485 youself or through some attorney ( other than your employer's), if you have the employment letter and I-140 approval.

    ITS ABOUT TIME.

    As an employee, Except for the 485 filing, you are not supposed to pay for anything for the GC. The company that sponsers you pays for all that.
    It is illigal for an employee to pay for the GC process.

    I am not sure what you are trying to get. Are you going to write a letter to USCIS that you commited an illigal act? And you want to involve bunch of people along with you?

    I am utterly confused here.

    Hey Guys ,

    I am EB2 - July 3rd 9:03 AM - R WIllialms - Nothing received yet ..

    I called up yesterday and the lady on the phone tells me that we need to wait 90 BUSINESS days before we can raise a service ticket etc - Which is like 4 months nearly - November 2nd.

    Anyone else got a similar response ?

    To my knowledge its not business days, its 90 calendar days.

    Hallo friends, I heard unofficial reports that the reason Dem and certain repub senators are so strongly supporting the cause of ilegal immig is because a huge lobbying group comprised of GC holders + citizens belonging to these groups (hispanics) have promised support to these senators. I therefore have a request to make to our more socially strong members in this group, Please contact our associations/groups and request their support. Mainly areas like CA, Chicago, Texas (dallas), washington etc etc where there are a lot of Indian / other foreign community. Lets get them to talk to their senators for us. And if they dont / are not willing to do that, we should also let them know that this will be anounced publicly to the Indian media / Govt. This is an important obligation on their part to support and raise their voice for us. We are a part of them and if they dont stand for us, we have to point that out publicly. Please somebody take charge of this and see that it happens. We H1b holders strugling for ourselves will not make any difference.

    the point here is not how long its gonna take.     Its not that I haven't made any efforts to reconcile with my ex-employer. I have tried and still trying to get them to have a civil conversation and settle this. But the more I try, i beleive, they r thinking the more scared i am and are being arrogant by not replying to any of my emails or phone calls. My reconciling efforts are giving them wrong hints i beleive. I am definetly stressed about this,thats true, but i am not scared because of all the info i gathered, I know even they do file a suit, I will be on the winning side. though i have option to go directly to DOL or USCIS and can show all the proofs i have regarding the deductions they have made, i haven't made till today just because of the kind of relationship we had earlier and also concerned about other h1bs who r with the company right now. I dont want their GC's to be in jeopardy. but if employer doesn't make the effort from his side, and pulls the thread till it breaks, i can't help it.

    All EB categories will be current all the time. As soon as a I485 EB case is filed the visa number should be allocated to the first 8000 odd cases for that category based on the PD of application. If a new case is filed tomorrow with a old PD he will get the visa number and the last guys application will move to waiting list. At the beginning of the year all visa numbers are allocated and nothing is wasted, even if the case is having issues like RFE, FBI check, etc the applicant knows that once cleared he will get his GC.

    Can you explain why you think the lawyers will laugh it off? Or is it just that you say it because someone is saying something which you don't agree with?

    A clarification regarding the flower campaign. I said the AILA law suit and the congresswomen letter to the chief also had lot of weight. It is just not the flower campaign for your information, if you beleive so it is your opinion just like I have mine.

    Correction, 25% of the less than 8000 visa numbers. First is the per country quota then its the distribution by quaters.

    That was pretty quick.
    Funny part is, I haven't received receipt notice yet.

    Santosh,

    I think INS or BCCS director have authority to make this provision for filing I-485 when dates are not current.This will atleast relieve many of us and our spouses/dependants from current uncertain situation.

    Can we all concentrate on this and take one at a time.
    What do we all have to do toward the efforts on this?
