Well, its ones own point of view. My point of view is, a bird in hand is better than two in the bush. Worst case, they'll revoke ur 485 but cannot deny u re-entry to the US based on ur H1B. But if u r on EAD, I'm not sure. Once u r back in the US, u can always dispute the denial by canceling ur Canadian PR and submitting the canceled documents alongwith ur dispute as proof which should definitely put ur GC application back in the reckoning. Again, the question is, is it worth taking the risk? Well, it is...because u didn't get ur Canadian PR just by sitting at home. U did the Finger Printing, U did the Indian PC, U took the english test, U did the medicals, spent so much of ur time, money and energy in the process. Now, by just foregoing all those efforts do u wanna have 100% hopes that ur GC wont be rejected and lose out on ur Canadian option as well? Think about it.
I dont have H1B stamp and i have already used AP, what if they revoke my 485 and ask me to go for stamping and i get stuck for month to receive clearance, i dont know any one in canada and staying in hotel and waiting for clearance could cause me 1000s of $ , not to say, i will not get my pay because my employer didnt do my canadian PR.
I agree, i did spend a lot fo money doing canadian PR process, i did hire a lawyer to do all these and cost me $5000+ but I guess its not worth taking the risk and losing all my savings, I think this is called destiny, being so close to something still not able to get that, meaning it was not meant for me....

There are various degrees of cursing and you were clearly crossing the line. I dont think the IV forum is a place to be "innovative" with cuss words.
If you are that "innovative", why dont you write that letter yourself. Why are you looking for the support of the IV community?
What have YOU done for the IV community except ask everyone to join you in your tiny specific micro-action items which benefit only a small fraction of the community like 5 people who have joined this law suit. Is that your definition of "innovation"? Coz if it is, I would much rather be a LOWLY Eb3 and fight for a common cause than be an "upper class" Eb2 fighting for just myself.

Today, John Cornyn, Senator from Texas, introduced in the Senate S. 2691, Securing Knowledge Innovation and Leadership (SKIL) bill, which is similar to the legal employment-based immigration bills incorporated in the comprehensive immigration reform bills of Senator Bill Frist and Senator Alen Specter. These legal employment-based immigration bills are similar to the Education bill named PACE Act which is still pending in the Senate.
Senator Cornyn strongly opposes the legalization of undocumented immigrants as opposed to the Senate Majority Leader Bill Frist and most of the Senators in the Senate Judiciary Committee. The compromised comprehensive immigration reform proposal faced strong challenge from Senator Cornyn before the bill collapsed in the Senate during the Easter break. Cornyn-Kyl bill and McCain-Kennedy has engaged in a fierce duel in the Senate Judiciary Committee and in the full Senate. The collision was marked by the legalization of illegal immigrants that are incorporated in the McCain-Kennedy bill.
By introduction of S. 2691, Senator Cornyn practically joins the original Bill Frist bill that strongly supported legal immigration and strongly opposed legalization of illegal aliens by focusing on the border security and the immigration enforcement. Question remains whether the legal immigration bill can pass the Congress as separate from the Comprehensive Immigration Reform legislation. We are concerned that this bill may bring a further division between the legal immigrant community and the illegal immigrant community with the potential damaging consequences to both legal and illegal communities. We have maintained a tradition of strongly supporting legal employment-based immigration. We just hope that the legal and illegal reform legislation does not end up with the fate of S. 1932 as driven by the political forces using the traditional battle tactic of 'divide and conquer.' From the perspectives of the legal employment-based immigrant community, all of the pending bills support their interest and they will be least affected by whichever bill the Congress finally would pass. maybe there are not enough EB3- I cases in the queue ;) ..well one of my friends did get his GC during last fiasco ..eb3 - I, pd 2003. ofcourse there is no unity ..it is every man for himself (And hence save as much as you can while you enjoy life)..and hence don't worry too much ..GC will come when it has to (my friend told me that once ..and I found those words comforting) ...see few of the threads nearby ..people are content talking about dots (I guess since they know nothing will ever happen due to our actions :-) ..and I sort of agree).
I also guess there are not much cases of EB3 left, atleast till PD dec 2002. Jun filers who ever did not get their GC last summer or fall will be waiting.

It ironic that you, of all people who got a GC through EB1, are questioning the importance of intellect over physical labor. It is no secret that human civilization has progressed and prospered only because some people have thought hard and attempted to invent new things. And the current EB preference system clearly reflects that importance of intellectual advancement to any society.
The cabbie or the waiter, with due respect their profession, is a mere cog in the wheel; a facilitator. But you my friend, the high skilled immigrant, have the ability to innovate and help your society progress. You have the education and understanding that can be passed on to future generations.
It is not to say that the waiter cannot invent, but the fact of the matter is five years on and he is still waiting tables.
I wonder if you were waiting in limbo for five-six-seven years, would you have still made this callous remark?
what makes you think you are more important to american society than the waiter or the cabbies? we all come to US under full disclosure but a hope that by the time our turn at GC (and Citizenship for those who care) comes - the queues would have shortened or the rules would have changed in our favor and we wont have to wait for so long......

also ..this looks very inaccurate ..because I know lot of indians who got H1 during the peak (when h1 was 195k) have gone back. i.e either they got better oppurtunities back home or just went back as they were not getting jobs. I did stay in one of the guest house which had lots of consultants ..none of them are here anymore !!

I did not call them to get the RNs but I got the I-485 checks cashed for my wife and me.
The checks for I-485 for my daughter and the checks for AP and EAD were not cashed though.
But again, looks like, July 3rd 9:03 received by R. Williams, is no more a MIA case.
By the way the receipt date is marked as Oct 10th. Service center is NSC.
